{"id":1715,"date":"2010-03-08T00:11:14","date_gmt":"2010-03-08T00:11:14","guid":{"rendered":"http:\/\/www.mortgageblogarticles.com\/?p=1715"},"modified":"2010-03-08T00:11:14","modified_gmt":"2010-03-08T00:11:14","slug":"can-i-get-a-loan-if-ive-had-a-recent-bankruptcy","status":"publish","type":"post","link":"https:\/\/dev203k.orbitwebx.com\/dev203k\/can-i-get-a-loan-if-ive-had-a-recent-bankruptcy\/","title":{"rendered":"Does A Bankruptcy Mean I Can&#8217;t Get A VA Loan?"},"content":{"rendered":"<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-21025\" title=\"VA loan after a bankruptcy\" src=\"https:\/\/dev203k.orbitwebx.com\/dev203k\/wp-content\/uploads\/2013\/12\/iStock_000009315285_ExtraSmall.jpg\" alt=\"\" width=\"400\" height=\"300\" srcset=\"https:\/\/dev203k.orbitwebx.com\/dev203k\/wp-content\/uploads\/2013\/12\/iStock_000009315285_ExtraSmall.jpg 400w, https:\/\/dev203k.orbitwebx.com\/dev203k\/wp-content\/uploads\/2013\/12\/iStock_000009315285_ExtraSmall-300x225.jpg 300w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/p>\n<p>Wondering if you can obtain a <a title=\"Veteran Affairs Informaiton\" href=\"http:\/\/www.va.gov\/\" target=\"_blank\" rel=\"noopener\">VA loan <\/a>after a bankruptcy is not an unusual question.\u00a0 With the recent economic recession just barely behind us, many veterans and military personnel are now in the position of looking for a new mortgage after having gone through a bankruptcy.<\/p>\n<p>Some of the most common questions asked regarding bankruptcies and VA loans are:<\/p>\n<ul>\n<li><strong>Can I even get a VA loan after a bankruptcy?<\/strong><\/li>\n<\/ul>\n<ul>\n<li><strong>If so, how long do I have to wait?<\/strong><\/li>\n<\/ul>\n<ul>\n<li><strong>What can I do to increase the likelihood of getting approved for a new VA loan after a bankruptcy?<\/strong><\/li>\n<\/ul>\n<p>The good news is that as of today, the VA underwriting guidelines are far more relaxed than the guidelines for conventional or FHA loans.<\/p>\n<p>With that said, let\u2019s now go ahead and take a look at the different types of bankruptcies and how they impact VA loans\u2026<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Chapter 7<\/span><\/strong><\/p>\n<p>Chapter 7 bankruptcies are essentially when the borrower is freed of all liability from creditors. <a title=\"VA Home Loans\" href=\"http:\/\/benefits.va.gov\/HOMELOANS\/index.asp\" target=\"_blank\" rel=\"noopener\">VA loan guidelines <\/a>typically call for a 2 year waiting period after a Chapter 7 bankruptcy before you can receive VA financing again.<\/p>\n<p>We say \u201ctypically\u201d because there are extremely rare circumstances in which the 2 year waiting period will be reduced to 1 instead. You would have to be able to show that circumstances beyond your control (such as losing a job or medical problems) were the driving force behind your financial hardship.<\/p>\n<p>This 2 year requirement may seem harsh, but compared to the guidelines for conventional loans that call for a 4 year waiting period, it really is quite reasonable.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Chapter 13<\/span><\/strong><\/p>\n<p>Chapter 13 bankruptcies involve the establishment of a repayment plan instead of being cleared of liability.<\/p>\n<p>Veterans and military personnel can qualify with VA loan guidelines even when they are still in Chapter 13 bankruptcy. However, you will have to show that you have made a minimum of 12 payments on-time and be approved by the court trustee for the loan.<\/p>\n<p>Please note that once the Chapter 13 bankruptcy is complete, veterans are instantly eligible for VA loans again, whereas<a title=\"Conventional Loans\" href=\"https:\/\/dev203k.orbitwebx.com\/dev203k\/conventional-loans-with-3-down-they-are-real\/\"> conventional loan <\/a>guidelines still require a 2 year waiting period.<\/p>\n<p>Even after you have finished the bankruptcy process, there are still actions you can take to increase your likelihood of qualifying for a VA loan after bankruptcy.<\/p>\n<p><strong>For example:<\/strong><\/p>\n<ul>\n<li>Reestablish your <a title=\"VA Credit Requirements\" href=\"https:\/\/dev203k.orbitwebx.com\/dev203k\/what-are-the-credit-scores-required-for-a-va-mortgage-loan-approval\/\">credit<\/a> as soon as possible if you do not have any creditors after the bankruptcy process. Remember, approving a potential borrower with no credit can be just as difficult as approving a borrower with bad credit!<\/li>\n<\/ul>\n<ul>\n<li>Once you reestablish credit, be sure to always make payments on time.<\/li>\n<\/ul>\n<ul>\n<li>Get in the habit of checking your credit at a minimum of once a year. This will give you an idea of where you stand, especially when you begin shopping for a VA mortgage.<\/li>\n<\/ul>\n<ul>\n<li>Upon the discharge of your bankruptcy, send a copy of all your discharge paperwork (including all applicable schedules) to the three credit bureaus: Equifax, Experian, and TransUnion.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>If you\u2019re wondering whether or not you can get a VA loan after a recent bankruptcy, you\u2019re not alone.
